An Examination Of The Contemporary Social Behavior Of Heirs And The Misconceptions About Their Rights In The Light Of Islamic Teachings

In the Holy Quran, the issue of inheritance is very important and it has been instructed to act justly on the fair and Shariah distribution of the right of inheritance and the heirs have been given legitimate rights by Shariah. Depriving any rightful person of inheritance is the worst sin. It is the importance of inheritance that Prophet Muhammad (peace be upon him) told the virtues of those who learn and teach inheritance and the punishment for those who do injustice in inheritance. In the Holy Qur'an, the word inheritance has been explained in terms of two meanings, financial inheritance and Knowledge inheritance. Knowledge inheritance is the name of a responsibility that is given by Allah Almighty to the individual and the nation of humanity and this chain continued from Hazrat Adam to Hazrat Muhammad صلى الله عليه وسلم and this is the beginning of intellectual inheritance. While inheritance of property is mentioned the most in the Qur'an, inheritance in Shariah rules is only an order whose distribution has been done by Allah. In this Article, the contemporary behavior of the heirs such as depriving the daughter of the property, marrying the Qur'an, not dividing the property, etc. And Misconceptions about the rights of heirs, including, monopoly of the elder brother, endowment of property, financial equality among the children during their lifetime, forced share of the children from the parents, girls giving up the inheritance by themselves, any Transferring the old father's property to his own name etc. is described.
